General Terms and Conditions of EIT Manufacturing East GmbH

EIT Manufacturing East GmbH provides its services exclusively on the basis of the following General Terms and Conditions (GTC). These apply to all legal relationships between EIT Manufacturing East GmbH and the customer, even if they are not expressly referred to.

Any terms and conditions of the customer shall not be accepted, even if known, unless expressly agreed otherwise in writing in individual cases. EIT Manufacturing East GmbH expressly contradicts any general terms and conditions of the customer.

Should individual provisions of these General Terms and Conditions be invalid, this shall not affect the binding nature of the remaining provisions and the contracts concluded on the basis thereof. The invalid provision shall be replaced by a valid provision that comes as close as possible to the meaning and purpose of the invalid provision.

The version valid at the time of the conclusion of the contract shall be decisive in each case.

Registration for Seminars and Trainings

Registrations will be considered in the order in which they are received. EIT Manufacturing East GmbH accepts registrations for its seminars and trainings in the online store and requires prior registration. The booking is in any case a binding contract and obligates the participant to pay the event fee.

Minimum and maximum numbers of participants apply to the seminars and trainings. If an event consists of a series of events, registration for this event is only possible in its entirety – unless individual registrations are offered; events missed by the customer cannot be made up free of charge.

For organizational reasons, registration is required no later than 3 (three) days prior to the start of the event, otherwise the participation in the respective event cannot be guaranteed. In order to be able to process your registration, it is necessary to provide complete data.

If you register a third person for a seminar or training, you expressly declare that you are authorized to make this registration.

Conditions of Participation

If attendance at a training event is subject to certain admission requirements, these are listed separately in the seminar program and must be fulfilled by the participant. The right to attend an event cannot be transferred to third parties. For participation in online formats and logging on to the platform, prior registration on the learning platform under the official name is required, among other things, for correct frequency recording. The use of aliases is not permitted. In addition to first name and surname, it is also necessary to provide address, telephone number and an e-mail address. Any changes to this data must be reported in writing to EIT Manufacturing East GmbH. Furthermore, the activation of the webcam is mandatory for participation in web seminars.

Training Location

All trainings can take place at different venues or online. Respective information will be announced in advance.

Event Fee

The fees for seminars and trainings are shown in the webshop. It is noted that EIT Manufacturing East GmbH assumes no liability for the accuracy of the fees shown therein and that these may vary in individual cases.

Unless otherwise stated, the event fee can be paid by online banking, debit or credit card. The event fee must be paid before the start of the event, otherwise participation in the event (use of the consultation) is excluded.

In case of late payment, the activation of the respective participant will be deactivated.

In the event of late entry into an event, a pro-rata reduction of the event fee is not possible; the same applies in the event of early exit.

The event fee does not include any additional costs for travel, meals or overnight stays.

Seminar Units

An online seminar unit includes approx. 4 hours of instruction, the on-site trainings approx. 8 hours. Breaks are determined by the trainers in consultation with the learning groups.

Scripts, Working Documents

For events, participants are provided with scripts or learning materials which, unless otherwise stated, are included in the event fee and are handed out at the beginning of the event or made available online. In case it is not possible to provide the documents at the beginning of the event, for example due to a last-minute booking, they will be provided at the earliest possible time. A separate purchase of scripts or learning material is not possible. The documents provided by EIT Manufacturing East GmbH may not be reproduced, distributed, offered for sale or made available to the public.

Image, Video and Sound Recordings

The taking of pictures, videos and sound recordings of the learning material, of the lecture or of persons during the events in presence and online is prohibited without exception.

Confirmation of Participation

Confirmations of attendance will be issued free of charge if the participant has attended at least 75% of the event in question, unless otherwise specified. The timely issuance of a confirmation of Participation requires the participant’s data to be submitted no later than 14 days before the start of the event.

Changes in the Event Program/Changes in the Type of Event (presence, online events)/Event Cancellation

Due to the long-term planning, organizational changes of the program and the type of event are possible. Likewise, the realization of an event depends on a minimum number of participants. EIT Manufacturing East GmbH therefore reserves the right to make changes to course days, start times, dates, event locations, event types (presence, online events), trainers and possible event cancellations in the event that the specified minimum number of participants is not reached, unforeseeable cancellations of course instructors or lecturers, or other circumstances that EIT Manufacturing East GmbH cannot foresee and cannot influence. Participants will be informed in due time. If an event is cancelled at short notice through no fault of EIT Manufacturing East GmbH, e.g. due to illness of the trainer or other unforeseeable events, there is no entitlement to the implementation of (parts of) the event. Compensation for expenses incurred and other claims against EIT Manufacturing East GmbH cannot be derived from this. The same applies to postponements or changes to the schedule and type of event that become necessary at short notice.

If an event has to be cancelled, any event fees already paid will be refunded without deduction. The refund will be made by bank transfer to an account specified in writing by the participant.

Cancellation Conditions

Cancellations of booked events can only be made in writing by e-mail to the above e-mail address. The cancellation becomes effective on the day it is received by EIT Manufacturing East GmbH. A cancellation fee will be charged for the cancellation depending on the date of receipt. The following cancellation conditions apply:

• Cancellations up to the 15th calendar day before the start of the event: free of charge
• Cancellations from the 14th calendar day before the start of the event: 50 % of the event fee
• Cancellations on the day of the event or afterwards: 100 % of the event fee (this also applies in case of agreed partial payments)

Price advantages resulting from the booking of a seminar series will be reversed if individual events are cancelled.

The cancellation fee is waived if the participant nominates a substitute participant who corresponds to the target group, attends the event and pays the event fee. However, the original participant remains liable for the event fee.

Right of Withdrawal

For distance selling transactions concluded with consumers the following applies:

You have the right to revoke this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day of the conclusion of the contract. In order to exercise your right of withdrawal, you must notify us, EIT Manufacturing East GmbH, address: Christine-Touaillon-Straße 11/29, 1220 Vienna, telephone +43 660 43 660 60, e-mail address:
support-east@eitmanufacturing.eu, by means of a clear declaration (e.g. a letter or e-mail sent by post) of your decision to revoke this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory. To comply with the withdrawal period, it is sufficient that you send the notice of exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation
If you revoke this contract, we shall reimburse you all payments we have received from you without undue delay and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount that corresponds to the proportion of the services already provided by the time you notify us of the exercise of the right of withdrawal with respect to this contract compared to the total scope of the services provided for in the contract.

Disclaimer

In cases of slight negligence – except for personal injury – any liability of EIT Manufacturing East GmbH and its employees, contractors or other vicarious agents for property damages or financial losses of the customer is excluded, regardless of whether it concerns direct or indirect damage, loss of profit or consequential damage, damage due to delay, impossibility, positive breach of contract, culpa in contrahendo, defective or incomplete performance. The existence of gross negligence must be proven by the injured party, unless the injured party is a consumer.

No liability claims can be asserted against EIT Manufacturing East GmbH for the application of the knowledge acquired at EIT Manufacturing East GmbH or for the correctness and up-to-dateness of the content of scripts, contributions or slide sets provided. EIT Manufacturing East GmbH assumes no liability for printing or typographical errors in its publications and internet pages.

References

Companies that become contractual partners of EIT Manufacturing East GmbH grant EIT Manufacturing East GmbH a right of use of the company’s name and logo for reference or advertising purposes.

Applicable Law, Place of Jurisdiction

Austrian substantive law shall apply. If the customer is a consumer, the mandatory provisions of the law of the state in which he/she has his/her habitual residence shall also apply.

The court with subject-matter jurisdiction for the registered office of EIT Manufacturing East GmbH shall have exclusive jurisdiction for disputes; however, EIT Manufacturing East GmbH reserves the right to invoke the general place of jurisdiction of the customer. If the customer is a consumer within the meaning of the Austrian Consumer Protection Act (KSchG), the statutory provisions shall apply with regard to jurisdiction.
